Bill targets enviro groups' lawsuits
polluter.jpgSix Republican senators and two house Republicans have introduced legislation that would require the Justice Department to publicly disclose reimbursements it pays out to environmental groups and others that sue the federal government under the Equal Access to Justice Act. The 1980 equal access law pays legal expenses for certain small entities that sue the federal government, but the lawmakers say that environmental groups have abused the statute to create self-perpetuating cycles of litigation over projects on public lands.

A student organization called Stream Access for All (SAFA) has formed to fight proposed legislation that would protect river outfitters but would effectively brand private boaters and anglers in Colorado as “criminal trespassers”

According to SAFA, here a few things wrong with the Colorado proposal – HB 1188

· It discriminates against private boaters and anglers by denying them legal access to Colorado rivers

· It invites criminal prosecution for trespass against private boaters and anglers

· It hinders Colorado tourism and recreation with the most restrictive river access laws in the United States
